Shacked respects intellectual property rights. If you believe content on the Services (such as a listing photo, description, or profile content) infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (“DMCA”) to our designated contact.

How to send a DMCA notice

For postal correspondence, contact us at the email above to request the current mailing address. Shacked is in the process of registering a Designated Agent under 17 U.S.C. § 512(c)(2) with the U.S. Copyright Office; once registration is complete, this page will be updated with the agent's registered information.

What your notice must include

Your notice must include all elements required under 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work claimed to be infringed.
  3. Identification of the allegedly infringing material and information reasonably sufficient to locate it (e.g., the listing URL or property ID).
  4. Your contact information (name, address, telephone, email).
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Misrepresentations in a DMCA notice may result in liability under 17 U.S.C. § 512(f).

Counter-notices

If you believe content of yours was removed in error, you may submit a counter-notice to the same email contact above. Your counter-notice must include the elements required under 17 U.S.C. § 512(g)(3), including a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification, and your consent to jurisdiction.

Repeat infringers

Consistent with 17 U.S.C. § 512(i), Shacked maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.
